Terms of Service
Version 1.0 · Effective September 16, 2026
These Terms of Service (the "Terms") govern access to and use of ACT Command™ (the "Service"), operated by ACT Care Providers, LLC, Anchorage, Alaska, United States ("ACT", "we", "us"). By creating an account, subscribing, or using the Service, the customer organization and its authorized users agree to these Terms.
1. The Service
ACT Command is subscription-based care-coordination operations software that helps organizations organize caseloads, track activities and deadlines, surface operational exceptions, monitor documentation workflows, and maintain oversight visibility.
The Service is offered in Independent, Agency Starter, and Agency Growth subscription editions. Enterprise arrangements are contracted manually and may be governed by an additional written agreement, which controls in the event of conflict with these Terms.
2. Subscriptions, fees, and recurring charges
Subscription fees are charged in advance on a recurring monthly basis for the selected plan until canceled or terminated. Current published plan pricing is Independent $399 per month, Agency Starter $999 per month, and Agency Growth $1,499 per month.
A one-time implementation and setup fee applies to initial onboarding: $750 for Independent, $2,500 for Agency Starter, and $4,000 for Agency Growth. The implementation fee is non-recurring and is not charged again on subscription renewal.
Payments are processed by our third-party payment processor. ACT does not receive or store complete payment card details. Fees are stated in U.S. dollars and, except where required by law, are non-refundable. Taxes, where applicable, are the customer's responsibility. ACT may change pricing on reasonable notice, effective at the start of a following billing period.
If a payment fails, the subscription may be identified as past due and access may be limited or suspended until the payment issue is resolved.
3. Accounts, authorized users, and security
The customer organization is responsible for the authorized users it permits to access the Service, for the accuracy of the user and role assignments it configures, and for all activity occurring under its accounts.
Credentials are personal and must not be shared. The customer must promptly disable access for users who are no longer authorized and must notify ACT of any suspected unauthorized access at support@actcommand.com.
Plan-based coordinator limits apply to the number of coordinators an organization may maintain in the Service under its subscription.
4. Acceptable use
Customers and users must not:
- copy, modify, distribute, resell, sublicense, or create derivative works of the Service;
- reverse engineer, decompile, or attempt to derive source code or underlying methods;
- share credentials, or attempt to access another organization's data or any account without authorization;
- circumvent, test, or interfere with access controls, security, or usage limits;
- use the Service unlawfully, or to store information the customer is not permitted to store;
- interfere with, overload, or disrupt the Service or its infrastructure.
5. Customer information and responsibility
The customer is responsible for the accuracy, quality, legality, and lawful use of all information entered into the Service, and for ensuring it has the authority and any required consents to enter that information.
The current production environment is not authorized for Protected Health Information. Users must not enter Protected Health Information until ACT Care Providers expressly communicates that a PHI-enabled production environment is available and the required technical, contractual, and operational safeguards are in place. Customers should enter only minimum-necessary operational information.
6. Intellectual property
ACT Command, including its software, source code, interfaces, designs, workflows, methods, templates, documentation, training materials, trademarks, and all related materials, is and remains the exclusive property of ACT Care Providers, LLC and its licensors. No rights are granted other than the limited, non-exclusive, non-transferable right to use the Service during a paid subscription in accordance with these Terms.
Customer information entered into the Service remains the customer's. The customer grants ACT the limited right to process it to operate, secure, support, and administer the Service.
7. Availability, maintenance, and changes
ACT aims to provide reliable access but does not guarantee uninterrupted or error-free operation. Scheduled and emergency maintenance, updates, and changes to features may occur. ACT may modify or discontinue features, with reasonable notice for material changes that adversely affect core functionality.
8. Suspension and termination
ACT may suspend or terminate access for non-payment, violation of these Terms, security risk, suspected unauthorized or unlawful use, or where required by law. Where reasonable, ACT will provide notice and an opportunity to cure.
9. Cancellation and effects of cancellation
Customers may cancel a subscription through the available billing process or by contacting support. Cancellation takes effect at the end of the current paid billing period; fees already paid, including implementation fees, are not refunded except where required by law.
Following cancellation or termination, access to the Service ends. Customers are responsible for exporting or retaining any records they require, in accordance with their own retention obligations, before access ends. ACT may delete customer information after a reasonable period following termination.
